Privacy and data protection policy

Your privacy is of the utmost importance to us. The purpose of this Privacy Policy is to inform you clearly and transparently about what personal data we collect, how we process it, for what purposes and on what legal bases, as well as the rights you have to protect it.

In this document we explain how we use personal data while you use our website. This processing is carried out in strict compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (GDPR), Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), and Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE).

One.- Identification of the data controller

In accordance with Article 11 of the LOPDGDD, we inform you that LAMBDA AUTOMOTIVE S.L. (hereinafter LAMBDA) is the entity responsible for processing the data provided by users through https://www.lambdamotive.com/ (hereinafter the WEBSITE).

The site https://www.lambdamotive.com/ is LAMBDA's main corporate website, which refers to the different services and solutions offered through the following links appearing on the website: https://www.efisuite.com, https://www.assisto.app/

Each service/solution has its own legal texts detailing the relevant information on data protection and cookies for each brand. LAMBDA therefore recommends that data subjects refer to them. This Privacy Policy is limited to informing users about the processing of their personal data on this website.

Two.- Definition of personal data

"Personal Data" means any information relating to an identified or identifiable natural person. This includes, among others, first name, surname, postal and e-mail address and telephone number.

Three.- Origin and categories of data processed

The personal data processed by LAMBDA come directly from the users themselves, provided through the forms or channels made available, for the proper provision of our services. We only process the data necessary to ensure proper attention and management of the service, which fall into the following categories:

  • Identification data: first name, surname, company name.
  • Contact data: e-mail address, telephone.
  • Connection and browsing data: IP address, device type, operating system, geolocation data (if you authorise it) and information collected through cookies (see our Cookie policy).

For website users who do not submit requests for information, only connection and browsing data will be processed.

No special categories of data (sensitive data) under Article 9 GDPR are processed (health data, ethnic origin, political opinions, religious beliefs, biometric data, etc.). The personal data requested are mandatory, so refusing to provide them may make it impossible for the user and LAMBDA to get in touch.

Any personal data you provide when visiting our website will be processed in accordance with data protection regulations and will only be collected, processed and used for lawful, legitimate and informed purposes.

Personal data may be subject to some of the following processing activities:

  • Processing of data of users and potential customers who contact LAMBDA to request information about our products or services.
  • Processing of employee data.

If the user provides third-party data, they declare that they have the consent of those persons and undertake to pass on the information contained in this clause, releasing LAMBDA from any liability in this respect. However, LAMBDA may carry out checks to verify this, adopting the appropriate due-diligence measures in accordance with data protection regulations.

Four.- Purpose of processing

LAMBDA will process the information provided by the User through the Website in order to manage the requests for information sent by the data subject about its products or services.

Where you give us your consent under Article 21 of the Spanish Information Society Services Act, we will use your identification and contact data to send you news that may interest you and information about our products and services.

These are all the purposes for which personal data are collected and used:

  • Managing requests for information sent by the data subject about our products or services.
  • Recruitment of staff to fill the necessary job vacancies.
  • Managing any legal issue affecting the company.

Five.- Legal basis for processing

LAMBDA is entitled to process your personal data on the following basis:

  • The free, specific, informed and unambiguous consent of the User, given by a clear statement or affirmative action, to offer our services and provide information about them where legally required. Withdrawal of this consent shall in no case affect the performance of other processing with a different legal basis, nor the lawfulness of processing carried out before such withdrawal.
  • Likewise, the processing of data for the purpose of sending electronic newsletters with offers, promotions, news and commercial information related to our services is also based on the explicit consent of the data subject. Legitimate interest will also serve for handling enquiries and complaints, fraud prevention and system security.

The consents obtained for the above purposes are independent, so the user may revoke one or more of them without affecting the others.

Six.- Automated decisions

As regards automated decision-making, profiling and the logic involved, the company will NOT make automated decisions, profiles or apply logic to your data.

Seven.- Recipients of the data and international transfers

The personal data provided by data subjects in the contact form of our website may be disclosed to the entities necessary for the proper provision of the service. This disclosure is based on the same legal basis as the main processing and includes both companies of the business group to which LAMBDA belongs and the following external IT hosting providers and communication platforms:

  • Google Workspace.
  • Clientify.
  • Mailchimp, the newsletter and advertising platform.

All these entities act as data processors, having signed the corresponding contracts and confidentiality agreements and on the basis of a contract in which they undertake to comply with the requirements of current data protection legislation. We guarantee that they will only process your data under our documented instructions, and may not use them for their own purposes or for purposes other than providing the service entrusted to them.

Apart from the providers mentioned above, the data will not be disclosed to other third parties, except where required by current legislation.

International data transfers

Some of our service providers are located in countries outside the European Economic Area ("EEA"). The location of these companies outside the EEA implies an international transfer of personal data, which could entail a lower level of protection than that provided by European regulations. However, at LAMBDA we have applied measures so that such transfers do not result in a lower level of protection of your personal data. Such international transfers take place under the terms set out in this privacy policy.

These are the international transfers made by LAMBDA:

LAMBDA contracts its virtual infrastructure for storing its database under a "cloud computing" model through Google Drive, with the information stored in the USA, under the Data Privacy Framework.

LAMBDA uses the CLIENTIFY platform to send transactional communications related to the services provided. This entity offers adequate data protection guarantees, as its providers adhere to the Data Privacy Framework, which guarantees the application of adequate security measures. LAMBDA AUTOMOTIVE SL uses the Mailchimp platform to send the entity's commercial communications where users have previously consented to receive them. This entity offers adequate data protection guarantees as it adheres to the Data Privacy Framework, and has also signed the Standard Contractual Clauses approved by the European Commission (SCCs). Eight.- Accuracy and truthfulness of the data collected

The data subject is solely responsible for the truthfulness and correctness of the data they make available to the organisation, releasing LAMBDA from any liability in this respect.

Data subjects guarantee and are responsible, in any case, for the accuracy, validity and authenticity of the personal data provided, and undertake to keep them duly updated. The data subject agrees to provide complete and correct information.

LAMBDA is not responsible for the truthfulness of information that it has not produced itself and for which another source is indicated, and therefore assumes no liability for any hypothetical damage that may arise from the use of such information.

LAMBDA is released from liability for any damage or harm the data subject may suffer as a result of errors, defects or omissions in information from sources outside the organisation.

Nine.- Retention periods

In compliance with the principle of storage limitation, LAMBDA guarantees that your personal data will only be processed for the time strictly necessary to fulfil the purposes for which they were collected in each case.

Once the purpose of the processing has ended, LAMBDA will block the data, which means that they will be identified and reserved, with technical and organisational measures that prevent their ordinary processing. Blocked data will remain exclusively at the disposal of Judges and Courts, the Public Prosecutor's Office or the competent Public Administrations to address any liability arising from the processing, during the corresponding limitation period. Once that period has elapsed, the information will be permanently deleted or irreversibly anonymised.

Ten.- Security

LAMBDA takes special care to guarantee the security of your personal data. Your data are stored in our information systems, where we have adopted and implemented technical and organisational security measures to prevent any loss or unauthorised use.

It will treat the User's data at all times in an absolutely confidential manner, keeping the mandatory duty of secrecy in accordance with the applicable regulations, and adopting the technical and organisational measures necessary to guarantee the security of the data and prevent their alteration, loss, processing or unauthorised access, taking into account the state of the art, the nature of the data stored and the risks to which they are exposed.

LAMBDA is not responsible for any hypothetical damage that may arise from interference, omissions, interruptions, computer viruses, telephone breakdowns or disconnections in the operation of this electronic system caused by circumstances beyond the organisation's control; from delays or blockages in the use of this electronic system caused by deficiencies or overloads of telephone lines, the Data Processing Centre, the Internet or other electronic systems; or from damage that may be caused by third parties through unlawful interference beyond LAMBDA's control.

Nevertheless, the control system implemented by LAMBDA makes it possible to comply with the principles of data processing, including purpose limitation, storage limitation, data minimisation, and integrity and confidentiality.

Eleven.- Exercise of rights

Where applicable, all users may exercise any of the rights granted by data protection regulations:

  • Right to request access to the personal data held by the organisation.
  • Right to request their rectification or erasure where the personal data processed by the organisation are inaccurate or untrue, are no longer necessary for the purposes of the processing, or there is no longer a legal basis for processing them.
  • Right to request the restriction of processing, in which case the data will only be kept for the exercise or defence of claims.
  • Right to object to processing, in which case our organisation will stop processing the data unless there are legitimate grounds preventing it.
  • Right to data portability where processing is carried out by automated means and is linked to LAMBDA on the basis of a signed contract or consent given for the processing.
  • Right to receive your personal data in a structured, commonly used and machine-readable format, or to have them transmitted directly to another controller where technically feasible.
  • Right not to be subject to individual automated decisions. The data subject may request that no decisions be taken based solely on automated processing, including profiling, which produce legal effects or significantly affect them.

If consent is given for a specific purpose, the user has the right to withdraw it at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

To exercise your rights, the following means are available:

  2. By sending a scanned and signed request to the e-mail address dpo@lambdamotive.com, with the subject EXERCISE OF PERSONAL DATA PROTECTION RIGHTS.

Furthermore, and especially if you consider that you have not obtained full satisfaction in exercising your rights, you may lodge a complaint with the national supervisory authority, the Spanish Data Protection Agency, C/ Jorge Juan, 6 – 28001 Madrid.

Twelve.- You do not wish to receive information from us or wish to withdraw your consent

Any user may object to the use of their information for advertising purposes, market research or satisfaction surveys, and may withdraw their consent at any time (without retroactive effect). To do so, send an e-mail to dpo@lambdamotive.com. When you receive advertising by e-mail, you can also object from that e-mail by clicking on the link included in it and following the instructions provided.

Thirteen.- Links to other websites

LAMBDA's website may contain links to other websites with the different services provided by LAMBDA and related companies. When you click on one of these links and access an external website, your visit will be subject to that website's privacy policy. We therefore recommend reading it through the links indicated in clause One, this privacy policy being released from any liability.

Fourteen.- Cookies

LAMBDA informs you that it has cookies installed on its systems. However, merely visiting this website or using LAMBDA's services does not automatically record any personal data identifying the User. Cookies are small text files that the browser stores on your computer's hard drive.

When you access the website www.lambdamotive.com, the server may recognise the cookie and provide information about your last visit, improving or facilitating the browsing experience, for example:

  • The date and time of access to the Website, making it possible to know the busiest times and make the necessary adjustments to avoid saturation problems at peak times.
  • The number of daily visitors to each section, making it possible to identify the most successful areas and expand and improve their content, so that users obtain a more satisfactory result, and to improve the design of the contents.
  • The date and time of the user's last visit to the Website, for analytical and statistical studies of the use of the website.
  • Security elements involved in access control to restricted areas.

Fifteen.- Changes to the Privacy Policy

Our Privacy Policy may be updated due to legal changes and requirements, as well as improvements and changes in the way we offer and provide our services. We therefore recommend that you visit our Privacy Policy periodically to learn about the latest changes. If such changes relate to the consent given by the user, a separate notification will be sent to obtain it again.

Sixteen.- Applicable law

This Policy shall be governed and interpreted in accordance with Spanish law, as shall the resolution of any dispute or disagreement relating to this Website. Use of the services of this website implies express acceptance of Spanish jurisdiction.
